In this paper we aim to shed light on the dynamics of regional identity construction and deconstruction. We will argue that four forms of identity can be identified that are linked through various processes of change. To that end, we will theoretically conceptualise 'identity' by discussing historical and current scholarly debates on identity in a variety of scientific disciplines. Then, we will argue that the mutual contradiction of the current theories is a paradox if seen from the angle of regional (...) identity construction and deconstruction. Building upon elements from the various theoretical approaches, we propose a heuristic model describing the dynamics of identity construction and deconstruction, which will be explored by means of the example of the Green Heart region, a spatial planning concept in western Holland. The publication in 1957 of the Wolfenden Report occasioned a celebrated controversy in which profound theoretical issues concerning the relation between law and morality, and the legal enforcement of morality were discussed. The principal disputants were Lord Justice Devlin and Professor H. L. A. Hart. It is by now well known that the main recommendation of the Wolfenden Report was the reform of the criminal law so that homosexual behaviour in private between consenting male adults should no longer be a (...) criminal offence. As homosexual behaviour in Christendom was at the outset punishable in the ecclesiastical courts, and subsequently, with the demise of the ecclesiastical courts, in the secular courts, the Wolfenden recommendation on homosexuality marked a major departure from the prevailing state of affairs in which the precepts of Christian morality, especially relating to sexual morals, were at first enforced by the ecclesiastical courts, and then by the secular courts. In early major works, Cassirer and Schlick differently recast traditional doctrines of the concept and of the relation of concept to intuitive content along the lines of recent epistemological discussions within the exact sciences. In this, they attempted to refashion epistemology by incorporating as its basic principle the notion of functional coordination, the theoretical sciences' own methodological tool for dispensing with the imprecise and unreliable guide of intuitive evidence. Examining their respective reconstructions of the theory of knowledge provides an axis (...) of comparison along which to locate Cassirer's Neo-Kantianism and Schlick's pre-positivist empiricism, and an immediate background of contrast to the subsequent rise of logical empiricism. For in the absence of intuition all our knowledge is without objects and therefore remains entirely empty. Aim: Patients with advanced cancer need information about end-of-life treatment options in order to make informed decisions. Clinicians vary in the frequency with which they initiate these discussions.Patients and methods: As part of a long-term longitudinal study, patients with an expected 2-year survival of less than 50% who had advanced gastrointestinal or lung cancer or amyotrophic lateral sclerosis were interviewed. Each patient’s medical record was reviewed at enrollment and at 3 months for evidence of the discussion of patient wishes concerning (...) ventilator support, artificial nutrition and hydration , resuscitation and hospice care. A Kaplan–Meier analysis was also performed and 2-year survival calculated.Results: 60 cancer and 32 ALS patients were enrolled. ALS patients were more likely than cancer patients to have evidence of discussion about their wishes for ventilator support , ANH , DNR and hospice care . At 6 months, 91% of ALS patients were alive compared with 62% of cancer patients; at 2 years, 63% of ALS patients were alive compared with 23% of cancer patients .Conclusions: Cancer patients were less likely than ALS patients to have had documented advanced care planning discussions despite worse survival. This may reflect perceptions that ALS has a more predictable course, that advanced cancer has a greater number of treatment options, or differing views about hope. Nevertheless, cancer patients may be less adequately prepared for end-of-life decision-making. (shrink)

The last chapter of Politian's first Miscellanea dealt with the amica silentia lunae through which the Greeks sailed back to Troy . He argued that the phrase should not be taken literally, as a statement that Troy fell at the new moon, but in an extended sense, as a poetic indication that the moon had not yet risen when the Greeks set sail. This reading had one merit: it explained how Virgil's moon could be silent while the Greeks were en (...) route but shine during the battle for the city . Yet Politian's effort to identify the phase of the moon described by Virgil was anything but clear: Non igitur aut sera fuerit aut pernox luna, tum nec lunae quidem omnino coitus, sed tempus arbitror potius quamdiu illa non luceret. Accordingly, though his arguments were sometimes repeated by commentators and teachers, they won little assent from scholars who occupied themselves seriously with the passage. In his Adversaria Turnebus took silentia lunae as referring ‘ad noctis taciturnitatem…non ad interlunium’. In the first chapter of his De rebus per epistolam quaesitis Giano Parrasio sharply criticised the fuzziness of Politian's explanation: ‘Ambages istae sunt, ambages’. More important, he quoted a line from the Little Iliad: νξ μν ην μέσση, λαμπρ δ' πέτελλε σελήνη. This he rendered ‘Nox erat intempesta, nitebat et aurea coelo Luna’, and inferred from it that the moon had been up when Troy fell. In his Virgilius collation scriptorum Graecorum illustratus, finally, Fulvio Orsini published a scholium on Euripides' Hecuba, one which quoted both the line from the Little Iliad and an analysis of it by the Peripatetic Callisthenes. Over the last ten years or so, John Stuart Mill’s position on paternalism has been thoroughly re-examined by philosophers. The majority view now seems to be that it is unreasonable to rule out paternalism altogether. The argument is often couched in vaguely utilitarian terms: the benefit of a particular paternalistic measure may so clearly outweigh the disadvantage, if there is any, that it is utterly unreasonable to object to it. For instance, it is unreasonable to object to a law enforcing (...) the wearing of seat belts when driving, given the enormous benefits and the minor irritation of having to conform. (shrink)

Мета. Реконструювати точку зору Гоголя щодо його антропологічного проєкту, тобто виявити його відповіді на питання про те, що собою являє людина у вимірах сущого та належного. Інакше кажучи, йдеться про з’ясування позиції Гоголя щодо принципів існування українця в російській імперії. Теоретичний базис. Наш погляд на спадщину Гоголя базується на концептуальних положеннях феноменології, екзистенціалізму та герменевтики. Наукова новизна. Вперше зроблена спроба вивчити спадщину Гоголя як розробку антропологічного проєкту. В процесі її реалізації автори, звертаючись до біографії мислителя, його листування та текстів, реконструювали (...) основні виміри цього проєкту. Уважне ставлення до особливостей антропології Гоголя дозволяє наблизитися до розуміння теоретичних парадоксів світогляду письменника та чинників його ранньої смерті як особистої життєвої трагедії патріота України. Йдеться про те, що Гоголь в процесі пошуку форм реалізації свого високого покликання поставив перед собою задачу — обґрунтувати утопічну мету. Для нього шляхи розбудови росії як великої держави передбачають вихолощення базових цінностей європейської культури та приниження гідності людини. Висновки. В ході дослідження творів Миколи Гоголя автори виявили: а) важливість світоглядно-філософських питань; б) проблеми людини в його спадщині. Аргументовано, що Микола Гоголь, вирішуючи задачу окреслення загальних рис природи людини, на ранньому етапі творчості демонстрував оптимізм та виразні життєстверджуючі риси, укорінені в україноцентризмі. Істотні зміни в світогляді нашого мислителя зумовили його намагання обґрунтувати альтернативний європейському варіант антропологічного проєкту, що передбачає виправдання нікчемності пересічного жителя росії та й самої імперії ціною заперечення здобутків європейської філософії та науки. Болісне переживання цього теоретичного дисонансу стало передумовою ранньої трагічної смерті Миколи Васильовича. Нині вона є своєрідним попередженням про неможливість поєднати українську культуру та культуру росії, тобто небезпеку нігілістичного ставлення до здобутків європейської культури, невід’ємною складовою якої є Україна. Перспективи подальшого дослідження спадщини Гоголя автори повʼязують із зосередженням уваги на його: а) критиці Просвітництва та б) зʼясуванні форм змістовної укоріненості його творчості в українській філософії, насамперед у вченні Григорія Сковороди. The American Antitrust Institute, a Washington, D.C. think tank, recently completed a study that concludes that competition law and policy plays little if any role in business ethics courses taught in U.S. business schools. To fill this intellectual void, this article makes a case for the development of a business ethics sub-field of antitrust ethics that is synonymous with the ethics of competitive strategy. After reviewing Paine''s Five Principles of Positive Competition and Boatright''s and Hendry''s views on the Moral Manager (...) Model and Moral Market Model, the need for ethical decision-making in a dynamic, innovative environment is explained through a Federal Trade Commission antitrust case involving the Dell Computer Corporation. The author argues that the contributions of Paine, Boatright, and Hendry provide an initial foundation for further research concerning the moral theories, principles, and rules pertaining to antitrust ethics, especially as it pertains to dynamic competition and "fair and competitive" executive behavior. In most countries, failed criminal attempts are punished less severely than those that succeed. Many philosophers, including myself, have argued that differential punishment can be justified. However, in a recent paper, Hanna raises objections to defenses of differential punishment, claiming that such policy goes against our “desert intuitions” and also cannot be justified on utilitarian grounds. I argue in this paper that Hanna’s desert-based and utilitarian objections can be undermined. Further, they are valid only within moral theories that take the (...) agent to be an independent self, whose responsibility rests on his or her intentions and deliberations alone. However, differential punishment can be justified in a different kind of moral theory, in which there are good reasons to give luck a role to play. (shrink)

Heidegger is well known for his views on technology. What would he have to say about the crowning glory of digital technology, the Internet? This paper argues that he would not reject the new technology, which would be just as inauthentic as being delivered over to it. Instead, Heidegger would urge us to reflect critically on it to see how we could develop a free relationship to it. He would say that in order to have a free relationship to it, (...) we need to avoid letting it serve to make us forget our Being as Being-in-the-world. An inauthentic relationship with the Internet occurs when we take to it because of the anonymity it affords, or because we mistake the wealth of information it makes available for real knowledge. For all that, Heidegger regards technology as having a “saving power,” or the potential to reveal Being. However, I argue that to be saved by technology’s saving power, we need to develop, on the one hand, what Foucault calls the “arts of existence,” and on the other what Habermas calls “human interests,” interests that will help realize the potential of the Internet.
